Join Me This Weekend: International Law Weekend NYC Panel on Careers in International Art Law

Careers in International Art Law Panel

When:  Saturday, October 26th at 3:30 p.m.-5:00 p.m.

Where: Fordham Law School, first floor, Manhattan, NYC.

Like many human activities, the art world is becoming increasingly international. Works of art regularly travel across borders in connection with exhibitions. These works also travel across borders in connection with theft, looting, and trafficking. Today, art is sold and distributed via the Internet and other transnational media in ways not imagined just decades ago. These phenomena and others have created the need for lawyers specialized in forms of licensing, contracting, and dispute resolution particular to the art world. The panel will explore career paths for lawyers interested in wedding a legal career to their passion for the arts -- careers in private law firms, in museums, in government, and in international bodies.

       Ray Dowd, author of West’s acclaimed Copyright Litigation Handbook and a partner at Dunnington Bartholow & Miller LLP in New York City and Glen McMurry, a distinguished litigator at Dungan & LeFevre in Dayton, Ohio will take us through the surprisingly complex rules of evidence.

       The object of taking discovery is to gather admissible evidence sufficient to sustain your client’s burden on the case- but how do you get the evidence admitted?

       Just what is “relevant evidence”? The first three rules of Article IV of the Federal Rules of Evidence govern the lion’s share of evidentiary disputes in copyright litigation. What exactly is hearsay, and when is it admissible in court in copyright litigation? And how do you get hearsay into evidence- or what is an exception to the hearsay rule?        How can you use motions in limine to include or exclude evidence in advance of trial? What does Rule 408 of the Federal Rules of Evidence exclude evidence of settlement negotiations?  When is a good time to use a trial or bench memorandum to preserve your objection for the record- especially to avoid judges’ hostility to objections? "The West" Versus "The East" Or United Europe?

I have been kindly invited by the Czech government to speak on an panel regarding legal obstacles to the recovery of Nazi-looted art in the United States.  I spoke on an expert panel in 2009 at the Prague Conference on Holocaust-era assets, I have been invited back for the Fifth Anniversary of the Prague Conference. The conference features experts from around the work from museums, archives, not-for-profits and governments who are struggling with issues related to provenance research, archives, and the problem of recovering artworks looted during the reign of Nazi terror.   The conference promises to explore different conceptions of provenance research, documentation and identification of looted cultural assets and the possibilities of the international cooperation in Europe and in the world.  I hope to see you there!
